Terms of Service

These Terms govern your use of Selira AI App. Please read them carefully — by using the Service you agree to be bound by them.
1. Acceptance of these Terms
By creating an account or otherwise using Selira AI App, you confirm that you have read, understood, and agreed to these Terms of Service.
2. Eligibility
You must be at least eighteen (18) years old to use Selira AI App. By using the Service you represent that you meet this age requirement.
3. Account creation
You agree to provide accurate information when creating an account and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials.
4. Nature of the Service
Selira AI App provides interactive conversations with virtual companions powered by artificial intelligence. The companions are not real people.
5. No real-world relationship
Any emotional, romantic, or playful interaction with an AI companion is part of the entertainment experience and does not constitute a real-world relationship.
6. Acceptable use
You agree to use the Service only for lawful, personal, non-commercial purposes and in a way that does not infringe the rights of any third party.
7. Prohibited content
You agree not to upload, request, or generate any content that depicts minors, non-consensual acts, threats, hate speech, or any other material that is illegal in your jurisdiction or ours.
8. Harassment and abuse
You agree not to use the Service to harass, threaten, or harm any individual or group, whether on the platform or off it.
9. No scraping or automation
You agree not to use bots, scrapers, or any automated tool to access the Service, except for public search engine crawling in accordance with our robots policy.
10. Reverse engineering
You agree not to reverse engineer, decompile, or otherwise attempt to derive the source code of any part of the Service.
11. Intellectual property
All software, artwork, personality designs, character names, and branding associated with Selira AI App are the property of Selira Studio Ltda. and protected by intellectual-property law.
12. User-generated content licence
You retain ownership of the messages you send. You grant us a limited licence to store and process them solely to deliver the Service to you.
13. Feedback
Any suggestions you send us may be used freely without obligation. We thank you in advance.
14. Subscriptions and billing
Some features require a paid subscription. Prices are shown inside the app at the moment of purchase and are charged in advance for each billing period.
15. Automatic renewal
Subscriptions renew automatically at the end of each billing period unless cancelled at least twenty-four (24) hours before the renewal date.
16. Refund policy
Except where required by local consumer law, payments are non-refundable. We may, at our discretion, offer goodwill refunds in exceptional cases.
17. Price changes
We may change subscription prices from time to time. You will be notified at least thirty (30) days before a price change takes effect.
18. Free trials
Free trials, where offered, automatically convert into paid subscriptions at the end of the trial period unless cancelled in advance.
19. Cancellation
You may cancel a subscription at any time inside the app. Cancellation takes effect at the end of the current billing period.
20. Suspension and termination
We may suspend or terminate your account if you violate these Terms or applicable law, or if we are required to do so by a competent authority.
21. Effect of termination
On termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination — for example intellectual property and disclaimers — will do so.
22. Data deletion on termination
Following account termination, your personal data is deleted in accordance with the retention rules set out in our Privacy Policy.
23. Modifications to the Service
We may modify, add, or remove features of the Service at any time. We will notify you of material changes inside the app.
24. Beta features
We may offer experimental features clearly marked as 'beta'. Beta features are provided 'as is' and may be modified or withdrawn without notice.
25. Disclaimers
The Service is provided 'as is' and 'as available'. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability and fitness for a particular purpose.
26. No medical, legal, or financial advice
Conversations with AI companions are for entertainment only and do not constitute medical, legal, financial, or any other professional advice.
27. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or one hundred euros (€100), whichever is greater.
28. Indemnity
You agree to indemnify and hold us harmless against any third-party claim arising from your breach of these Terms or your misuse of the Service.
29. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, outages of third-party infrastructure, or acts of government.
30. Governing law
These Terms are governed by the laws of Portugal, excluding its conflict-of-laws rules.
31. Jurisdiction
Any dispute arising out of these Terms will be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal, unless mandatory consumer-protection law provides otherwise.
32. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
33. No waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
34. Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely in connection with a merger, acquisition, or sale of assets.
35. Changes to these Terms
We may update these Terms from time to time. We will revise the 'Last updated' date and, for material changes, notify you inside the app at least fourteen (14) days before they take effect.
